These Terms of Service (“Terms”) govern your access to and use of StockFilters (“Platform”), a product and service operated by Magnum Opus Trading LLC (“Company,” “we,” “our,” or “us”). By accessing or using the Platform, creating an account, subscribing, or otherwise using any portion of the services, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Platform.
1. Eligibility
You must be at least eighteen (18) years old and legally capable of entering into binding agreements to use the Platform.
By using the Platform, you represent and warrant that:
* you are at least 18 years old;
* you have authority to enter into these Terms;
* your use complies with all applicable laws and regulations.
2. Educational Purposes Only
StockFilters is an educational and informational technology platform only.
Nothing on the Platform constitutes:
* investment advice;
* financial advice;
* legal advice;
* tax advice;
* brokerage services;
* portfolio management;
* securities recommendations;
* solicitations to buy or sell securities;
* fiduciary services.
Magnum Opus Trading LLC is not registered as:
* an investment adviser;
* broker-dealer;
* commodity trading advisor;
* financial planner;
* fiduciary.
Users are solely responsible for all investment, trading, and financial decisions.
3. No Guarantee of Results
Trading and investing involve substantial risk.
No content, filter, screener, scanner, chart, alert, educational material, AI-generated output, or platform functionality guarantees:
* profitability;
* trading success;
* risk reduction;
* future performance.
Past performance does not guarantee future results.
Any testimonials, screenshots, simulations, examples, case studies, hypothetical returns, or demonstrations are illustrative only and may not reflect actual trading performance.
Users may lose some or all invested capital.
4. Market Data Disclaimer
The Platform may display market data, charts, analytics, indicators, or information sourced from third parties including:
* TradingView;
* Polygon;
* Massive;
* exchanges;
* data vendors;
* other providers.
Such information may be:
* delayed;
* inaccurate;
* incomplete;
* interrupted;
* unavailable;
* subject to outages or errors.
The Company does not guarantee the accuracy, completeness, reliability, timeliness, or availability of any market data.
Users acknowledge that market disruptions, software failures, internet interruptions, exchange outages, and periods of volatility may impair functionality.
5. No Brokerage or Execution Services
The Platform does not:
* execute trades;
* route orders;
* hold customer funds;
* provide custody;
* connect to brokerage accounts;
* manage portfolios.
Users are solely responsible for all trading activity and execution decisions.
6. Account Registration
Users may be required to create an account to access portions of the Platform.
Users agree to:
* provide accurate information;
* maintain confidentiality of credentials;
* immediately notify the Company of unauthorized access.
Accounts are:
* personal;
* non-transferable;
* non-sublicensable.
Account sharing is strictly prohibited.
7. Subscription Billing
The Platform operates on recurring subscription billing.
By subscribing, you authorize recurring charges through Stripe or other payment processors for:
* monthly subscriptions;
* annual subscriptions;
* applicable taxes and fees.
Subscriptions automatically renew unless canceled before the next billing cycle.
Users are responsible for managing cancellations before renewal dates.
8. Free Trials
The Company may offer free trials or promotional access periods.
Unless canceled prior to expiration, free trials may automatically convert into paid subscriptions.
The Company reserves the right to:
* modify trial eligibility;
* revoke trials;
* limit repeated trial usage;
* terminate abuse of promotional offers.
9. No Refunds
All purchases are final.
Refunds are not provided except:
* where legally required;
* in cases of duplicate charges;
* verified fraudulent transactions.
Chargebacks or payment disputes may result in immediate suspension or permanent termination of access.
10. Prohibited Conduct
Users may not:
* copy, reproduce, scrape, distribute, republish, or commercially exploit Platform content;
* reverse engineer the Platform;
* create derivative or competing products;
* use bots, automation, or scripts to extract data;
* use outputs to train artificial intelligence or machine learning systems;
* publicly repost proprietary filters, analytics, screenshots, or scanner outputs;
* circumvent technical protections or account restrictions;
* create multiple accounts to evade bans, pricing, or limitations;
* interfere with Platform functionality;
* harass, threaten, impersonate, or abuse others;
* use the Platform unlawfully.
11. Intellectual Property
All Platform content and technology are owned exclusively by Magnum Opus Trading LLC, including:
* software;
* source code;
* filters;
* scanners;
* algorithms;
* analytics;
* AI outputs;
* branding;
* educational materials;
* methodologies;
* interfaces;
* layouts;
* proprietary systems.
No ownership rights are transferred to users.
All rights not expressly granted are reserved.
12. AI Features
The Platform may include AI-generated outputs, summaries, analytics, or educational content.
AI-generated information:
* may contain inaccuracies;
* may be incomplete;
* should not be relied upon for financial decisions.
The Company makes no representations regarding AI-generated outputs.
13. Monitoring and Enforcement
The Company reserves the right to:
* monitor Platform usage;
* investigate suspected misconduct;
* suspend or terminate accounts;
* cooperate with regulators or law enforcement;
* restrict access without notice.
14. Termination
The Company may suspend or terminate access at any time, with or without notice, for any reason or no reason, including:
* credential sharing;
* abuse;
* harassment;
* fraud;
* payment disputes;
* legal or regulatory concerns.
Termination does not waive any rights or remedies available to the Company.
15. No Warranty
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING:
* MERCHANTABILITY;
* FITNESS FOR A PARTICULAR PURPOSE;
* NON-INFRINGEMENT;
* ACCURACY;
* RELIABILITY;
* AVAILABILITY.
The Company does not guarantee uninterrupted or error-free operation.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGNUM OPUS TRADING LLC SHALL NOT BE LIABLE FOR:
* INDIRECT DAMAGES;
* CONSEQUENTIAL DAMAGES;
* LOST PROFITS;
* LOST OPPORTUNITIES;
* TRADING LOSSES;
* DATA LOSS;
* BUSINESS INTERRUPTION;
* SPECIAL OR PUNITIVE DAMAGES.
Total liability shall not exceed the amount paid by the user to the Company during the twelve (12) months preceding the claim.
17. Indemnification
Users agree to indemnify and hold harmless Magnum Opus Trading LLC and its affiliates from any claims, damages, liabilities, losses, or expenses arising from:
* use of the Platform;
* violation of these Terms;
* unlawful conduct;
* misuse of data or content.
18. Arbitration and Class Action Waiver
Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively through binding arbitration administered by JAMS.
Arbitration shall occur in Miami, Florida.
Users waive:
* class actions;
* representative actions;
* jury trials.
The Company may seek injunctive relief in court for:
* intellectual property misuse;
* unauthorized access;
* data scraping;
* confidentiality breaches.
19. Governing Law
These Terms are governed by Delaware law without regard to conflict-of-law principles.
20. International Use and Compliance
Users may not use the Platform in violation of:
* U.S. export laws;
* sanctions laws;
* embargo regulations.
Users represent they are not located in prohibited jurisdictions or on restricted-party lists.
21. Electronic Communications
By using the Platform, users consent to receive:
* transactional notices;
* product updates;
* marketing communications;
* legal notices;
* subscription notices.
Electronic communications satisfy legal communication requirements.
22. Modifications
The Company may modify:
* pricing;
* features;
* subscription plans;
* functionality;
* these Terms;
* Platform access.
Continued use after updates constitutes acceptance.
23. Assignment
The Company may assign or transfer these Terms in connection with:
* mergers;
* acquisitions;
* reorganizations;
* asset sales;
* financing transactions.
Users may not assign their rights or accounts.
